Terms and Conditions

The following terms and conditions ("Terms and Conditions") set forth the contractual agreement between Yeti Airlines Limited ("Yeti Airlines") and the Member (as such term is defined hereinafter). Guests are advised to read these Terms and Conditions prior to making an application for membership of the Yeti Airline's Sky Club Program. Further, Members are advised to read these Terms and Conditions before quoting the Sky Club membership number to Yeti Airlines or any Program Partner of Yeti Airlines.

The Members are further advised that no clause be read in isolation. The rule of construction, if any, that a contract should be interpreted against the parties responsible for the drafting and preparation thereof, shall not apply.



Definitions

In these Terms and Conditions, unless the context otherwise requires, the following terms shall have the same meaning as set out hereinafter:

  1. "Applicant" refers to any individual who fills in and mails the Sky Club Enrolment Form to Sky Club Customer Service Centre or enrolls in the Sky Club program from the Yeti Airlines website: www.yetiairlines.com.
  2. "Base Sky Mileage Points" or “Base Mileage Points” means the Mileage Points accumulated by the Member in the Sky Club Membership account for flying on valid Yeti Airlines flights and appearing on a statement issued by Yeti Airlines. These Mileage Points are included to determine Membership and its status, as and when applicable.
  3. “Data” means information personal to a Member, including without limitation, name, address, telephone number, date of birth, employer, Mileage Points accumulated, contacts with Yeti Airlines, any information received from a Program Partner as a result of using services provided by the Program Partners and other travel data.
  4. "Fraud" means fraud, dishonesty, and deceit, and includes, without limitation, knowingly supplying incorrect information at any time to accrue Sky Mileage Points, attempting to accrue Sky Mileage Points for sectors that have not been flown or are not eligible for Sky Mileage Points, altering any documents to procure Sky Mileage Points, attempting to accrue Sky Mileage Points for sectors flown by any person other than the Member, using or attempting to use stolen or counterfeit tickets on Yeti Airlines, attempting to accrue Sky Mileage Points more than once for the same sector, selling, bartering and/or purchasing Sky Mileage Points or Sky Rewards, including attempting to sell or transfer Sky Mileage Points or Sky Reward Points by means of Internet based sales or auctions, knowingly benefiting from the Fraud or Misconduct of another Member or individual.
  5. "Guest" means a passenger or customer of Yeti Airlines.
  6. “Sky Club or Sky Club program" means the loyalty program driven by Yeti Airlines offering benefits, facilities or arrangements to a Member on account of their Membership with Sky Club.
  7. “Sky Club Card" or "Membership Card" means the membership card issued by Yeti Airlines to a Member.
  8. “Sky Reward Ticket" means a free ticket issued to a Member by Yeti Airlines on redemption by the Member of an appropriate part of that Member's Sky Mileage Points from the Member's Sky Club Membership account. However a service charge of 15 percent will be charged.
  9. “Sky Mileage Points" means the Base Mileage Points earned by a Member by flying in the Valid Flight of Yeti Airlines.
  10. "Sky Reward Points" means any tickets, rewards or benefits that are issued against redemption of Sky Mileage Points.
  11. "Member" means a Guest enrolled as a member of the Sky Club.
  12. "Membership" means membership of the Sky Club.
  13. "Processing" means obtaining, using, examining and verifying or recording in any electronic or any paper form.
  14. "Processed" means the completion of Processing.
  15. "Program Partners" means any airline, company or organization designated as Program Partner by Yeti Airlines.
  16. "Qualifying Flight" or "Valid Flight" means a flight operated by Yeti Airlines in selected Sector flown by the Guest upon the purchase of a paid ticket against the fare that is eligible for earning Mileage Points.
  17. "Sector" means a single direct eligible flight sector between two destinations, such as Kathmandu - Pokhara.

Membership/Membership Cards

  1. Sky Club membership is free of cost.
  2. Membership to the Sky Club program is open only to individuals who are above 12 years of age and who are Nepalese citizen or foreigner including Indian Nationals who reside in Nepal with a valid residence permit working for multi national company, diplomatic agency, embassy and consulate and other expatriate and subject to local laws and regulations at the time of enrolment in the Sky Club Program.
  3. Membership is not open to companies, partnerships, unincorporated associations or such other entities.
  4. Membership to Sky Club is offered at the sole discretion of Yeti Airlines and Yeti Airlines may refuse membership to any person without assigning any reasons.
  5. The Sky Club Membership number will be specified on the Sky Club card. The Guest becomes entitled to use the Membership number specified on the Sky Club card as soon as the Member gets the Sky Club card. However, the Mileage Points are credited to the account only once the application of the Guest is approved by Yeti Airlines.
  6. The Yeti Club Membership card and Membership number may be used only by the Member.
  7. The Sky Club card and the Sky Club account numbers are non-transferable.
  8. The Sky Club card is not a credit card and may be used only for purposes that have been defined in the Sky Club program.
  9. In the event of loss of Sky Club Membership card, a duplicate card shall be issued on a written request to Sky Club Service Centre and the charges applicable for the issue of a duplicate Membership card shall be NRs. 100/- (payable by cash or a/c payee cheque drawn in favor of "Yeti Airlines"). The Member shall be solely liable for any fraud or loss caused to Yeti Airlines by such lost Membership card.
  10. Fraud or misuse of Sky Club Membership card or Sky Club program benefits may result in termination of Membership or withdrawal of benefits at the discretion of Yeti Airlines.
  11. In case of Fraud or misuse of Sky Club Membership card or account, the Member concerned would be personally liable for any and all costs, taxes, charges, claims or liabilities of any nature, arising from the benefits, facilities or arrangements provided or made available to a Member by Yeti Airlines or its Program Partners pursuant to the Membership to the Sky Club program.
  12. Yeti Airlines will endeavor to procure that the services, benefits, facilities and arrangements as expressed or advertised by the Program Partners will be available to Members, however, Yeti Airlines will not be liable for any loss or damage, whether direct or indirect arising from the provision or non provision, whether whole or part, of any such services, benefits, facilities or arrangements by its Program Partners.
  13. In addition to these Terms and Conditions, when a Member seeks to use or obtain any services, benefits, facilities or arrangements offered by a person or entity other than Yeti Airlines, including without limitation, a Program Partner, the Member would be bound by the respective terms and conditions of the provider of said benefits, facilities or arrangements.
  14. Failure of a Member to quote the Sky Club Membership account number and name as mentioned on the plastic Sky Club Membership card or the enrolment form (where the plastic Sky Club Membership card has not been issued) when booking and/or checking in for flights on Yeti Airlines or its Program Partners may result in applicable Sky Mileage Points not being credited to the Member's account and neither Yeti Airlines nor its Program Partner will have any responsibility for such failure of Yeti Airlines to credit Mileage Points.
  15. The Sky Club Membership card shall at all times remain the property of Yeti Airlines and Yeti Airlines reserves the right exercisable at any time in its absolute discretion and without giving notice or assigning any reasons to such Member to refuse or revoke Membership.

Enrolment

  1. A Guest may apply to become a Member by filling and submitting an enrolment form to Sky Club Customer Service Centre, Yeti Airlines Airport Office, and Yeti Airlines Sales Counter.
  2. Alternatively, Guests may apply online to enroll in the Sky Club program through Yeti Airline’s website; www.yetiairlines.com
  3. Guests who have so submitted a completed enrolment form to the Sky Club Customer Service may quote the Membership number specified in the enrolment form, however, Membership is subject to confirmation by Yeti Airlines and no credits of Sky Mileage Points will accrue or be honored until the duly filled enrolment form has been processed by Yeti Airlines and the same has been notified by Yeti Airlines to the Guest.
  4. An applicant for Membership must supply all the information required in the Sky Club Membership application form.
  5. Applications will not be considered for enrolment if found incomplete in any manner or if any of the details provided at the time of enrolment are found to be incorrect or non factual.
  6. Yeti Airlines may accept or reject any application for Membership in its absolute discretion and without assigning any reasons. If an application for Membership is rejected, then any benefit that may have accrued to such Guest shall automatically stand forfeited.
  7. The Member will be mailed their plastic Sky Club Membership card within one week inside Kathmandu valley and within two weeks outside Kathmandu valley after submitting a completed Membership application form at Yeti Airlines Office.
  8. The Membership number as provided on enrolment will entitle the Member to accrue Sky Mileage Points until the Member has received the plastic Sky Club Membership card.
  9. The Sky Club Membership card shall at all times remain the property of Yeti Airlines and Yeti Airlines reserves the right exercisable at any time in its absolute discretion and without giving notice or assigning any reasons to such Member to refuse or revoke Membership.
  10. The Member shall return the plastic Membership card to Yeti Airlines within 15 working days from the date when requested to do so by Yeti Airlines.

Validity of Membership and Mileage Points

  1. The program comprises of Sky Club of the Yeti Airlines.
  2. Sky Club membership are valid for three years and are reviewed annually.
  3. Yeti Airlines may, from time to time, change the number of flights operated by Yeti Airlines, the Base Mileage Points needed to qualify for the Basic Sky Mileage Points accrued by a particular travel on any Sector, without any requirement of giving prior notice to the Member.
  4. Sky Mileage Points are not transferable and cannot be combined with Sky Mileage Points of any other Sky Club Membership account or a loyalty or frequent flyer program of a Program Partner of Yeti Airlines.
  5. At no time may Sky Mileage Points be credited to, or Sky Reward Points be purchased by or sold to or transferred to any person. Any such transfers of Sky Mileage Points or Sky Reward Points are void and would make the Sky Mileage Points liable to be forfeited. Any person who commits or attempts to commit any of the foregoing acts is liable to indemnify for any actual or expected damages, litigation and related costs to Yeti Airlines and/or its Program Partner (as the case may be). Yeti Airlines reserves the right to terminate Membership of such Member. It is hereby clarified that a Member may redeem Sky Mileage Points for Sky Reward tickets (in accordance with the procedure specified in this regard) in the name of any person/s chosen by the Member.
  6. Sky Mileage Points can be accumulated only once per valid flight per Member, regardless of the number of seats purchased. Sky Mileage Points will be credited only to the Member who has traveled on the flight, on the relevant sector, and not to any third party, irrespective of who has paid for the seat.
  7. Sky Mileage Points will accrue for each Sector flown on a Qualifying Flight only. The Member must travel on an eligible fare to qualify for Sky Mileage Points.
  8. The following category of tickets/travel do not entail accrual of Sky Mileage Points:
    • Travel on gratis or Free of Cost (FOC) tickets.
    • Refunded, forfeited and unused tickets, including non-refundable tickets.
    • Yeti Airlines employees, travel agents, tour conductors and/or other persons traveling on non-revenue basis or travel industry/cargo customer discount fares.
    • Free tickets of any kind, including Sky Reward tickets issued under this program.
    • Tickets purchased to carry excess baggage (EB) such as beddings, utensils, etc or to provide extra space for the primary passenger.
    • Tickets bought during promotional schemes.

Profile Update and Member’s Data

  1. The responsibility of advising Sky Club Customer Service Centre of changes in name, address, contact details or preferences in writing, lies with the Sky Club Member.
  2. Name change requests will have to be made in writing duly signed by the Member and accompanied with the supporting legal documentation specified at the time of making the request.
  3. By using the plastic Sky Club Membership card and/or quoting the Sky Club Membership account number to Yeti Airlines and/or any Program Partners, a Member consents/authorizes to Yeti Airlines creating, maintaining and updating Data. The Data will be maintained and updated for the purpose of providing relevant information and services to the Member.
  4. For reasons of security and identity verification, a Member may be asked certain questions before revelation of Data pertaining to the Member that is held by Yeti Airlines.
  5. Where a Member has registered online or if the Member's signature has not been registered with Yeti Airlines, Yeti Airlines reserves the right to require the Member to produce valid photo identity proof (such as passport/ driver's license/ Citizenship Certificate or such other identity proof as Yeti Airlines may deem proper) for verification.
  6. Only the Member would be eligible to obtain Data from Yeti Airlines relating to his/her own Membership, however, Yeti Airlines may disclose Data relating to a Member to a third person who has been nominated in this regard in writing by the Member to Yeti Airlines in advance. Not withstanding the foregoing, any and all Data or information in a Member's Sky Club account may be disclosed by Yeti Airlines, as may be required by law, including without limitation, disclosure to the police, immigration and customs authorities.
  7. In an effort to provide valuable information and offers to Members, Yeti Airlines develops mailing lists for use by themselves and their Program Partners. These lists are developed under strict conditions designed to safeguard the privacy of the Member's information. As part of providing value added services to the Sky Club Members, Yeti Airlines reserves the right to send special offers/products to the Members regarding Sky Club, Yeti Airlines and/or its Program Partners.
  8. Consent to receive such offers will be deemed as given until such time that the Member expressly withdraws his/her consent to receive mails and offers from Yeti Airlines and its various Program Partners by opting out of the relevant preference either by notifying the Sky Club Service Centre in writing or online on Yeti Airlines website. Yeti Airlines will remove, or in the case of a Program Partner, make efforts to procure the removal of, the name of such Member from the mailing list within 30 working days. Withdrawal of consent may result in certain services not being offered and/or provided to the Member.

Earning Mileage Points and Mileage Points Calculation

  1. Members earn Sky Mileage Points (as is reflected in Sky Mileage Points Chart), that Yeti Airlines may at any time in its discretion, terminate or alternate; for travel undertaken on a Qualifying Flight operated by Yeti Airlines. Members can check the fare rules for flights eligible to be a Qualifying Flight with the Sky Club Service Centre.
  2. Sky Mileage Points will be earned by the Member only on successful completion of the flight.
  3. The Sky Mileage Points for a valid flight on Yeti Airlines shall be based on the Sky Mileage Points chart, which shall be prepared by Yeti Airlines. The number of Sky Mileage Points for a valid flight will be based on the Membership’s validity and sector of travel. Qualifying flights flown on fares less than full fares may not accrue any Base Sky Mileage Points.
  4. To ensure credit of Sky Mileage Points, the Member must make all his/her bookings in the same name as printed on the Sky Club Membership card, or where the Membership card has not been issued, as submitted in the Sky Club enrolment form and/or temporary card.
  5. To earn Sky Mileage Points, the Member must quote the Sky Club Membership account number at the time of making the booking and also present the plastic Sky Club Membership card at the time of check-in.
  6. If a Member gets involuntarily re-routed by Yeti Airlines on another carrier for reasons within Yeti Airline’s reasonable control, and the original Yeti Airlines flight on which the Member was booked would have qualified for Basic Sky Mileage Points, the Member may request for credit by sending the booking details, i.e. PNR No. and date of travel along with the original boarding pass and ticket of the airline on which the travel has been endorsed, to the Sky Club Service Centre. Basic Sky Mileage Points would be credited on confirmation of the above.
  7. No Sky Mileage Points will be accrued where a flight operated by Yeti Airlines booked is cancelled or re-routed due to any reason beyond the reasonable control of Yeti Airlines, including without limitation, weather delays.
  8. All activities that are not tracked automatically at the time of travel may be credited later at the discretion of Yeti Airlines subject to the claim for Sky Mileage Points being made within 3 months from the date of travel or the relevant transaction.
  9. The Member is solely liable to check whether the Sky Mileage Points have been correctly credited to the Sky Club Membership account or not.
  10. Members are advised to retain their boarding passes till the Sky Mileage Points accrued appear on their quarterly statement. Members shall immediately and in any case within 3 months from the date of travel, report any omissions or errors in their Sky Club Account to the Sky Club Customer Service Centre via email, fax or online form at www.yetiairlines.com.
  11. Yeti Airlines is not responsible for the delivery of any correspondences addressed to Sky Club Customer Service Center.
  12. Altered, mutilated or illegible documents will not be accepted for the purpose of crediting or debiting of Sky Mileage Points.

Renewal/Retention

  1. The Membership is valid for three years from the date of Membership, unless extended by Yeti Airlines.
  2. The validity of Sky Mileage Points and Membership are independent of each other.

Communication/Statements/Correspondences

  1. Members will be emailed a quarterly statement reporting all the activities recorded in their Sky Club Account since the statement for the previous month. The summary statement indicates the Sky Mileage Points earned on Yeti Airlines flights as well as any redemption activity.
  2. In case of a dispute about entitlement to Sky Mileage Points, Yeti Airlines may require proof of travel including the retained segment of the boarding pass and passenger receipts for the Sector claimed to have been flown. Claims must be lodged in writing or on Yeti Airlines website no later than 3 months from the date of travel.
  3. Sky Club Members, who have not had their email addresses recorded with the Sky Club Customer Service Center or through Yeti Airlines website, would be sent a biyearly paper statement.

Redeeming Mileage Points

  1. Members may redeem their Sky Mileage Points for a Sky Reward ticket only after having recorded a minimum required mileage points in their Sky Club account.
  2. Sky Reward Points shall be issued in the sole discretion of Yeti Airlines and only for Sectors served by Yeti Airlines.
  3. Sky Reward Points will be issued for the valid route between origin and destination sectors requested for by the member.
  4. Sky Reward Tickets shall be issued only after the Member pays the applicable FSC (Fuel Surcharge) and other applicable governmental charges.
  5. Sky Reward Tickets:
    • Sky Reward Tickets on Yeti Airlines may be requested for both one-way and return tickets.
    • Sky Reward Tickets are valid till the date of travel only and cannot be extended under any circumstances.
    • Sky Reward Points may be issued to a Sky Club membership name requested by the Member prior to issue of the Sky Reward ticket.
    • Sky Rewards Tickets issued against Sky Mileage Points are not eligible for earning Sky Mileage Points.
    • Yeti Airlines reserves the right to limit the number of seats made available for Sky Reward tickets at its absolute discretion and without requirement of giving any prior notice to the Member.
    • Sky Reward Points are subject to the rules and restrictions of the appropriate governments and governmental entities.
    • Sale, purchase or barter of Sky Mileage Points is not permitted and will be considered a breach of these Terms and Conditions, unless the transaction is carried out with Yeti Airline’s consent and by its authorized personnel. Sky Reward tickets do not have any monetary refund value.
  6. Procedure for redemptions:
    • Sky Reward tickets for Yeti Airlines can be redeemed by submitting a written request to the Sky Club Customer Service Centre in the prescribed form filled in and duly signed by the Member.
    • The Member must provide at least three working days for Sky Club Customer Service Centre to process the request, but the duration depends upon the availability of seats in the aircraft.
    • The applicable taxes and governmental charges are payable at the ticketing counter by the Member.
  7. A request for Sky Reward will not be considered valid unless completed in all respects and duly submitted by the Member. In case of a written request for redemption, unsigned requests will not be processed. Yeti Airlines reserves the right to verify the signature on the request form submitted by the Member with the signature on the enrolment form or proof of identity provided by the Member.
  8. Sky Reward Points will be booked and issued directly by Yeti Airlines. No other person, including without limitation, travel agencies are authorized to issue Sky Reward Points.
  9. No open dated Sky Reward tickets shall be issued under the Sky Club program.
  10. The Sky Reward will be issued only after the Member has paid the applicable taxes or governmental charges at the time of taking the Sky Reward.
  11. The Guest will be responsible for all other expenses and any other charges, claims or liabilities arising in relation to the use of Sky Reward tickets.
  12. No Sky Mileage Points will be redeemed in the case of infants (under 2 years of age) traveling with a Member on a Yeti Airlines ticket. However, the Member shall be liable to pay the taxes/charges applicable on the infant ticket.
  13. Redemption requests may be made through Yeti Airlines Office no later than Duration before departure of relevant flight.

Changes & Cancellation of Reward Points

  1. Changes to Sky Reward tickets would be accepted through Yeti Airlines Office till 72 hrs (3 days) before departure of the flight for which the Reward ticket was originally booked and would be subject to availability and other terms and conditions set forth herein.
  2. Cancellation of Sky Reward tickets will be permitted up to 2 hours before departure of the flight (for which the Sky Reward Ticket was originally booked), subject to a cancellation charge of 10 percent of the airfare or corresponding Sky Mileage Points, which would be debited to Member’s Sky Club Membership account, required for the new Sky Reward Ticket.
  3. Sky Mileage Points for Sky Reward Tickets that have not been cancelled and are not utilized will not be re-credited to the Member's account and shall be deemed as utilized.
  4. In the event of a no-show on Sky Reward tickets (Members or Guests who do not present themselves in time for their booked flight), the redeemed Sky Mileage Points will not be credited back into the Membership account and shall be deemed as utilized.
  5. Sky Mileage Points re-credited against cancellation or as a difference in the changes to the Sky Reward ticket, will be only re-credited if the Sky Mileage Points are valid as on the date of such cancellation or a change to the Sky Reward ticket. If not, such Mileage Points stand forfeited.

Audit & Disqualification

  1. Yeti Airlines reserves the right to audit the Member's Sky Club account at any time, without notice to the Member, to ensure compliance with the Terms and Conditions of the Sky Club program, Yeti Airline’s conditions of carriage (which apply to all Guests) and applicable governmental regulations.
  2. Yeti Airline’s conditions of carriage include a prohibition against actions involving fictitious multiple bookings. In the event that the audit reveals discrepancies or violations or fraud, the processing of Sky Reward and Mileage Points summaries may be delayed or suspended until such discrepancies, violations or fraud is resolved.
  3. The Membership account of any Member breaching or violating the Terms and Conditions may be withheld (e.g. Sky Mileage Points may not be redeemed from a withheld account).
  4. Yeti Airlines may impose charges on such Members by deducting Sky Mileage Points from their Sky Club accounts.
  5. Yeti Airlines also reserves the right to disqualify any Member from further participation in the Sky Club program if in Yeti Airline’s sole judgment; such Member has breached the Terms and Conditions or violated the conditions of carriage or any of the rules described herein.
  6. Data in physical form will be retained by Yeti Airlines up to a maximum of 3 months after which Yeti Airlines may, at its option, preserve an electronic copy of the same.

Termination of Membership

  1. If a Member wishes, he/she may terminate the Membership by providing notice in writing and by surrendering the plastic Sky Club Membership card to Sky Club Customer Service. However, such termination of Membership by a Member shall not relieve him/her from any obligations, which are intended to survive, or by its nature survives the termination of Membership. The Member will not be then bound by any continuing obligations under these Terms and Conditions.
  2. Yeti Airlines may at any time in its discretion, terminate or suspend the Membership of any Member and /or the right of any Member to use the Sky Club Membership card. In case of such termination by Yeti Airlines, the Sky Mileage Points in the Sky Club account of such Member shall stand forfeited. In the case of suspended Membership, Yeti Airlines may in its discretion, debit Sky Mileage Points and/or request undertakings in respect of future conduct to revive the Membership.

Change/Termination of the Program

  1. All transactions/activities in the Sky Club program are subject to the Terms and Conditions, any other applicable rules and regulations of Yeti Airlines governing such activity and are further subject to all applicable laws and regulations.
  2. These Terms and Conditions may be changed by Yeti Airlines from time to time in its absolute discretion and without any requirement of prior notice to the Members. Participation in Sky Club is subject to the Terms and Conditions and a Member shall be deemed to have accepted the Terms and Conditions (as then existing) each time when such Member quotes the Sky Club Membership number to either Yeti Airlines or to any of its Program Partners.
  3. Yeti Airlines may in its discretion at any time, without giving notice, change or modify or terminate the Sky Reward structure by revising the Sky Mileage Points levels required to attain a particular Sky Reward, stipulate a specified period during which Sky Mileage Points cannot be redeemed, limit the number of seats available for the redemption of Sky Mileage Points to any or all destinations or on certain specified flights, alter the number or types of journeys required to obtain a particular Sky Reward; change, modify or withdraw the Sky Mileage Points chart, Program Partners affiliations, change the parties from which a Sky Reward may be obtained/redeemed, change the length of time after being rewarded within which Sky Mileage Points must be redeemed; impose a time limit upon validity for redemption of any Sky Mileage Points issued by Yeti Airlines; introduce and/or review Membership fees; any special offers, and modify and change the procedures and rules relating to ticketing on redemption of Sky Mileage Points, as well as any benefits provided in connection with the Sky Club program and any special offers or promotional offers made to any tier or group of Members or any other aspect of the Sky Club program.
  4. Yeti Airlines may in its discretion at any time, without giving notice, change the Sky Club program rules, regulations, Sky Reward Points, Mileage Points reward levels and special offers at any time without notice. This means that Yeti Airlines may initiate changes, for instance, impacting partner affiliations, rules for earning and credit of Sky Mileage Points, rules for redemption of Sky Reward Points against Sky Mileage Points, continued availability of Reward Points, blackout dates or limit the seats available for Reward travel to any or all destinations including but not limited to allocations on Reward seats on certain flights.
  5. Yeti Airlines may terminate the Sky Club program (in its entirety or part) at any time but will use its reasonable endeavors to give at least three months' notice to Members. At the end of the period of notice, the Members right to use the services or receive any benefits under or pursuant to the Sky Club program, including without limitation, the earning and redemption of Sky Mileage Points will cease. The Member's legal heir, on production of relevant documents can redeem the Sky Mileage Points available in the deceased's Sky Club account, subject to the validity of the Mileage Points and the Membership itself. Limitation of Liability.
  6. Yeti Airlines and/or Program Partners shall not be liable to any Member or to such Member's nominee or companion or guardian, for any direct, indirect or consequential loss, damage or expense of any kind whatsoever, arising out of or in connection with the Sky Club program and/or the provision or the refusal to provide any benefits or service, whether such loss, damage or expense is caused by negligence or otherwise, and whether Yeti Airlines and or its Program Partners have any control over the circumstances giving rise to the claim or not.
  7. Yeti Airlines will not be liable for any loss arising from the failure by Program Partners to provide services or benefits to which a Member may be entitled to undergo pursuant to the Sky Club program.
  8. The Terms and Conditions shall be governed by and construed in accordance with Nepalese Law. Yeti Airlines and the Member irrevocably submit to the exclusive jurisdiction of the courts and tribunals of Kathmandu to resolve any disputes that may arise out of or in connection with Sky Club program.
